Standard Terms and Conditions for Competitions

Note:

Below are the standard terms and conditions applicable to all competitions conducted/promoted partly or wholly by or associated with 2oceansvibe.com and/or 2oceansvibe Radio Proprietary Limited (“2OV competition/s”).

Your entry into any 2OV competition/s shall be deemed to be your acceptance of the competition rules and the terms and conditions as set out below. By participating in any 2OV competitions, where entry is online, participants further agree to be bound by 2oceansvibe’s website terms of use.

“2OV and/or “2oceansvibe and/or “2oceansvibe Media Group” means any of the entities forming part of the 2oceansvibe Media Group, including but not limited to the website, 2oceansvibe.com, 2oceanvibe Radio, 2oceansvibe TV, 2oceansvibe Lottos and any reference to “2OV” also includes its members, directors, employees and advertising, marketing and promotional service providers and its sponsor/s; and

“You” or “the Entrant” means the person entering the competition subject to the terms and conditions set out herein.

1. Entrants below the age of 18 (eighteen) should obtain their parents or guardians consent before entering the competition and 2oceansvibe reserves the right to require an Entrant to show proof of age before accepting such Entrant’s entry into the competition and/or awarding a prize.
2. No person enter the same or any other competition hosted partly or in whole by 2OV within 90 (ninety) days of winning the same or any other competition hosted partly or in whole by 2OV.
3. All entries must be made personally by the Entrant. No person may on behalf of a third party, enter any competition hosted partly or in whole by 2OV.
4. Entry into 2OV competition/s is done entirely at the Entrant’s own discretion and own risk.
5. 2OV competitions are subject to all applicable laws and regulations of South Africa, unless specifically otherwise stated in the competition.
6. No employees, members and directors of the 2oceansvibe Media Group, their agencies, and members of their immediate family, nor any members of the sponsor of any competition and/or any of their affiliated companies and/or agencies and members of their immediate families, may enter any 2OV competitions.
7. The judges’ decision is final and no correspondence will be entered into.
8. Prizes are not transferable, cannot be converted to cash or credit and are not negotiable. Subject to sponsor agreements and/or other agreements that may provide otherwise, in respect of 2OV competitions sponsored by third parties, that third party sponsor is entirely responsible for any prizes won through such 2OV competitions and the Entrant shall hold 2oceansvibe harmless in respect of any prizes that the sponsor fails to deliver.
9. Entrants of 2OV competitions accept that certain other conditions may apply, as prescribed by 2oceansvibe and/or a specific sponsor of a competition. Where there are specific terms and conditions in addition to these terms and conditions, such terms and conditions will be set out on www.2oceansvibe.com.
10. Subject to sponsor agreements and/or other agreements that may provide otherwise, where 2oceansvibe has agreed to deliver prizes to winners of 2OV competitions, 2oceansvibe will only deliver within a 40 kilometer radius from its head office in Cape Town, and any winners resident or located outside of this area will be responsible for collecting their prize or will be accountable for any costs incurred in respect of the delivery or collection of their prize.
11. The prize/s as described in any advertising and promotion of the 2OV competitions and/or in any specific terms and conditions relating to specific competition. 2oceansvibe Media Group shall not be responsible for any sponsor’s prize/s being unavailable or out of stock. Where a competition is wholly hosted by 2oceansvibe and the prize/s are unavailable or out of stock, 2oceansvibe reserves the right to replace in its discretion any unavailable prize with a substitute equal to the value and/or specification of the unavailable prize.
12. 2oceansvibe cannot be held responsible for any incorrect or incomplete information supplied by entrants that may cause 2oceansvibe to be unable to contact an Entrant or a winner. Any prizes not collected within 30 (thirty) days from the date of being advised that you are a winner are automatically forfeited and 2oceansvibe may dispose of such prize in its discretion. You agree that you shall have no claim/s against 2oceansvibe in respect of any incorrect or incomplete entry into any 2OV competitions and/or with regards to any prize forfeited on the above basis.
13. Once prizes have left 2oceansvibe’s place of collection, 2oceansvibe and their associated agencies and sponsors take no responsibility for prizes damaged, delayed or lost in transit.
14. Any applicable warrantees or guarantees in relation to the prizes or the use thereof is strictly concluded between the supplier or manufacturer, as the case may be, of the prize/s and the winners directly and 2oceansvibe cannot and does not make any representations nor does it give any undertakings or guarantees in relation to any prize won through any 2OV competitions. The Entrant hereby agrees that he/she shall hold 2oceansvibe completely harmless against any liability of whatsoever nature howsoever arising in relation to such prize.
15. In the event of the winner or any party experiencing any problems of whatsoever nature with the prize, such person shall be obliged to contact the supplier of the prize directly and 2oceansvibe shall not be obliged to engage with the winner in any way in this regard.
16. By entering, Entrants acknowledge compliance with these competition rules and hereby release 2oceansvibe and its advertising and promotion agencies, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (collectively “Releasees”), from any claims, losses, actions, or damages, whether actual, incidental or consequential, arising out of or relating to Entrant’s participation in 2OV competitions, or the use or misuse of any prize won through 2OV competitions.
17. To the full extent permitted in law, all entrants and winners hereby indemnify 2oceansvibe, its advertising agencies, advisors, suppliers and nominated agents against any and all claims (including but not limited to direct, indirect or consequential) arising howsoever from their participation in 2OV competitions or subsequent usage of a prize and/or any failures or errors in the broadcast of any advertisement relating to the competition or the publication of any material, including statements made by any staff member, journalist, other entrants or any other person.
18. By participating in 2OV competition/s, the Entrant agrees that 2oceansvibe may directly or through its marketing, promotional and advertising service providers, send the Entrant marketing and promotional materials via email or SMS. Should the entrant wish at any time to stop/ OPT OUT of receiving any marketing or promotional material, entrants may contact 2oceansvibe on editor@2oceansvibe.com and/or 021 4216673 to instruct 2oceansvibe in this regard.
19. By participating in 2OV competitions, the winner agrees that 2oceansvibe may without obtaining the consent of the winner may publish (in or on national or regional media and online), the winner’s name and/or photograph of the winner for promotional and official purposes at no additional cost to 2oceansvibe. You hereby agrees to such publication.
20. If for any reason, any 2OV competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of 2oceansvibe which corrupt or affect the administration, security, fairness, integrity or proper conduct of any competition, 2oceansvibe reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition.
21. All copyrights and trademarks (whether registered or unregistered) including but not limited to text, logos, names or illustrations are the property of 2oceansvibe Media Group or its sponsors, as the case may be. All rights fully reserved.
