It’s not the greatest thing to have lost faith in your client – and even worse when you’re overheard telling the opposition that’s how you feel. Especially in a case such as Oscar Pistorius’. After delivering arguments to the Supreme Court of Appeal yesterday, Oscar’s lawyer Barry Roux was overheard telling State prosecutor Gerrie Nel he, Barry, was going to “lose”. After court had adjourned yesterday afternoon, pool microphones for the broadcast picked up on the two advocates’ lil’ chat as the proceedings had been broadcasted live. The context, however, is unclear, but after a muffled chat, Barry was clearly heard saying:
…maar dat ek gaan verloor is feite. [But that I am going to lose is a fact.]
When Gerrie was asked to comment, perhaps providing some context, he was unable to, insisting that the mics should have been switched off:
No, I can’t. You should speak to Roux about it.
Barry is yet to respond.
Whoever is responsible for the recordings will be held in contempt of court as there is an “absolute bar” on audio recordings of legal representatives, according to the SCA court.
