Just when you thought you might have heard the last about dear Oscar the wheels kick into motion once more.

Judge Masipa, her of the famous ‘dolus eventualis’ interpretation, today denied a bid to prevent the State from appealing his culpable homicide conviction. Not great news for the former Olympic hero, with News24 reporting as follows:

Pistorius’s lawyers wanted to appeal Masipa’s decision granting the State leave to appeal his conviction in the Supreme Court of Appeal…

Masipa had granted the State’s application to appeal Pistorius’s culpable homicide conviction, but dismissed its application to appeal his five-year jail sentence.

The State wants him to be convicted on the more serious charge of murder.

Gerrie Nel and Barry Roux then engaged in a bit of verbal sparring, with Nel claiming that Masipa should not have even given a ruling on the matter. Roux argued that the defence had legal rights to present their argument.

One feels these two must be tired of the sight of one another, although a quick look at their bank balances must be all that is required to put on the sparring gloves once more.
