Trevor Noah is pulling the ultimate American move and suing.
In his crosshairs are a prestigious New York hospital and an orthopaedic surgeon over an alleged “botched surgery”.
The Daily Show host claims to have suffered from a “serious personal injury”, of which the exact details have not been disclosed, but which is “permanent, severe and grievous”.
Noah is suing Hospital for Special Surgery (HSS) and Dr Riley J. Williams III who took him in for surgery on November 23, 2020.
The lawsuit was filed on November 29 this year in the New York County Supreme Court claiming, above all, “negligence” during and after said surgery.
The Independent has more:
The documents state that the accused “were negligent and careless in failing to treat and care for” the patient “in a careful and skillful manner”. It also stated that they failed “to use approved methods in general use in the care and treatment” of the political commentator.
The lawsuit stated that the accused failed “to prescribe proper medications”, failed to “discontinue certain prescription medications”, and failed “to use proper tests and examinations in order to diagnose the conditions from which” the celebrity “was suffering”.
The lawsuit was filed by Justin Blitz of Schulman Blitz LLP, who mentions that the 37-year-old TV host’s “serious personal injury” allegedly left Noah “rendered sick, sore lame and disabled”.
The lawsuit goes on:
It also alleged that the accused failed “to inform the plaintiff of the risks, hazards and alternatives to the treatment”.
“A reasonably prudent person in the position of the plaintiff would have refused the treatment rendered, had they been so informed of the risks, hazards, and alternatives to the treatment rendered,” the lawsuit said.
Per Law and Crime, Dr Williams has a rather impressive track record:
[He] is listed as a Yale- and Stanford-educated “orthopedic surgeon in the Sports Medicine Institute at HSS specializing in knee, shoulder and elbow surgery.”
He is listed as “Medical Director and Head Team Orthopedic Surgeon for the Brooklyn Nets (NBA) and New York Liberty (WNBA) professional basketball teams.”
The lawsuit alleges that Noah “sustained severe nervous shock, mental anguish, severe emotional distress and great physical pain” and was confined to bed for “a long period of time”.
Due to the alleged botched surgery the South African comedian “has suffered loss of enjoyment of life”. That’s something we can all relate to after the past 20 or so months.
Sounds like a horrendous ordeal, for sure.
The hospital has hit back, calling Noah’s claims “meritless”.
