Although it has been months since South African rugby legend Joost van der Westhuizen passed after a long battle with motor neurone disease, finally, the issue regarding his will has been dropped.
The battle began when Joost’s will was rejected by the Master of the High Court.
Joost had allegedly made a new will in 2015, in terms of which his children would inherit everything. It is alleged that he left his wife, Amor Vittone, only a television set and made it clear that she “may not receive any direct benefit from the J9 Trust,” reports IOL.
The two were married, although separated at the time of his death.
In the will, Joost also stated that:
[I]t was important for him that his children maintained a good relationship with his parents. He asked that the trustees assist in this regard.
However, he wasn’t able to sign the will as he was already ailing. Instead, his lawyer Ferdi Hartzenberg signed it as Commissioner of Oaths, but someone had to sign on behalf of Joost, hence the rejection.
Now, Joost’s family have decided to no longer go ahead with legal proceedings to try to declare the will left unsigned as valid:
It is understood that most of Joost’s assets have in any event been moved to the J9 Trust, to be administered by trustees. They are in the process of being appointed. Joost’s two children, Jordan, 13, and Kylie, 11, are beneficiaries of the trust.
It is understood that the assets in the trust, among others, include two properties. The children will benefit from the trust once they have come of age.
Rather, a will has been submitted by Amor, signed by both of them in 2009, in terms of which she inherited everything in the estate:
This includes Joost’s half of their home in Dainfern Valley in Joburg. Amor owned the other half.
The family will not contest this either, as IOL reports they are not interested in any further confrontation with Amor regarding Joost’s assets.
