It’s now definitely fine to shoot anyone that comes near your house, whether you know for sure they are a burglar or not. Oscar Pistorius got an effective 10 months, and this guy got zero jail time.
Moletsane sentenced Nobunga to seven years in prison, which is suspended for five years, meaning he would be jailed for seven years should he be found guilty of the same offence in the next five years.
This is becoming quite ridiculous, “[t]he accused’s wife testified that they were sleeping at night when they heard something moving on the roof and her husband grabbed his gun and shot in the victim’s direction”. So basically he did not know what was on his roof, and allegedly shot in the direction of the noise, killing an unknown man in the process.
Magistrate Edgar Moletsane said that this is a serious crime:
A normal person could not shoot directly at his attacker just to frighten him. You were supposed to think before you took the shot because now someone’s life has been taken away… Sir, this is a serious crime
Moletsane still gave him a sentence that means no jail time, unless he does the same thing within five years – Okay wait, so he is stripped of his gun ownership license, and told that if he doesn’t do the same crime (shoot at something and if it is a person, kills it, without knowing what he was shooting at) he wont have to serve any jail time? Is this a joke?
