With a lot of talk about Oscar Pistorius calling his ex-girlfriend just hours before shooting Reeva Steenkamp, and that his brother, Carl, deleted phone messages and history, people are definitely talking and asking questions if this news will be taken into account back in the courtroom.
According to criminal lawyer Ulrich Roux, it won’t.
“It can’t have an impact as it is not evidence which has been led before court. Neither parties can use or refer to this information for sentencing as the evidence was not led before court.”
Well, that’s lucky for Oscar.
Speaking about phone data being deleted, Roux went on to say that unless it could be proven that the information had been “intentionally erased”, it would have no impact.
