It’s taken almost six years and a long argument with the Umngeni (Howick) Municipality, but Lorraine Margaret Burns has finally been awarded R450 000.
Burns was involved in a car accident in 2008, which she claimed was caused by the pothole, and she landed up in hospital for three weeks with shoulder and head injuries.
Burn’s attorneys made a case that the municipality failed to repair potholes on the Umngeni-Curry’s Post road. They had a great response…
“Burns was negligent in failing to keep proper watch, failed to avoid the pothole, and did not exercise reasonable care and skill. This negligence caused, or contributed to the accident.”
I mean, why should SHE have to avoid a pothole that shouldn’t even be there?
At least she won the case and can now go on a lovely vacation and sip vodka-tonics on a tropical beach.
