If you recall, we posted a story last week about Kanye West’s showstopping proposal to Kim Kardashian. Later, we managed to acquire some actual video footage of the proposal – and it is that video footage that is now involved in a major court case, where Kim K is looking to sue YouTube co-founder Chad Hurley for posting a video of the proposal online at his new Internet venture MixBit.
Kim filed a lawsuit just last week, claiming that Hurley was not invited to San Francisco’s AT&T Park to attend the proposal, but that he just waltzed in with someone who was already invited. Apparently he was caught trying to sneak in, but was allowed in on the condition that he would not publish details of the proposal.
He promised verbally, and signed a confidentiality agreement that he would do no such thing. He was photographed holding the signed confidentiality agreement, and the photo is included in the suit. We should think that this basically means that there’s no way out for the YouTube co-founder. The lawsuit reads:
Hurley is well aware of such contractual restrictions — including not to usurp a person’s right to tell a story on his or her own terms, and for his or her own emotional and financial benefit. Nevertheless, Hurley proceeded to try to turn the event into one starring himself, broadcasting the images he knew were the exclusive property rights of someone else.
All things considered, this idea was doomed from the start.
