That’s disgraced High Court Judge, Nkola Motata, who was convicted of DUI in 2009, and given a R20 000 fine, after crashing his Jaguar through a wall in Hurlington, Gauteng, and then allegedly verbally abusing the owner of the wall, not to mention officers that arrived on the scene. Since his appeal against the sentence was tossed out on its ear, Judge Boozy Von Drunk-a-tonne has been on special administrative leave.
Now Judge Motata has re-emerged, filing papers with the Pretoria High Court against Justice Minister, Jeff Radebe; the Judicial Services Commission and Advocate GC Pretorius SC, claiming their action against him, which has kept him off the bench (or, from falling off it) since September last year, is “unconstitutional and unlawful”. He is also appealing the decision to conduct a Judicial Tribunal against him, after Afriforum brought charges of racial misconduct against him.
Motata says, in papers:
It is submitted that the conduct of Radebe and the JSC to keep me at home and not allow me to perform my duties is unconstitutional and unlawful. I have the right to pursue my occupation as a judge…Charging me with misconduct for an offence that has not been created is unconstitutional as it is against the principle of legality.
It’ll now be up to the JSC, Afriforum and other accused to answer Judge Motata in court. Afriforum has vehemently opposed the application, claiming that a man with a criminal conviction has no place on a high court bench.
