Julius Malema has been suspended from the ANC, and ANC Youth League for FIVE YEARS.
Unlike many of the other sentences handed to other core members of the ANCYL, Malema’s sentence is effective immediately.
Relating to lesser charges, Malema and four other Youth League leaders have been suspended from the ANC for two years, but this sentence is suspended for three years and will be only be implemented if they are found guilty of any other contravention during that period.
ANCYL Secretary General Floyd Shivambu has also thus far been found personally liable for libel and misconduct and guilty of bringing the ANC into disrepute. He has been suspended from the ANC for 18 months, with the sentence suspended for three years.
Relating to more serious charges, Shivambu has been suspended immediately from the ANC for a period of three years. He will need to vacate his position on the ANC’s NEC, and as spokesperson of the ANCYL.
The lengthy verdict is being read by National Disclinary Committee chair Derek Hanekom, at Luthuli House in Johannesburg.
In his verdict Hanekom has rejected the notion that the ANCYL is autonomous, and it was made clear that the ANCYL is not permitted to act outside of the ANC constitution. He has also pointed out that ill-discipline and disobedience are not a cure for frustration, and that Malema and other senior leaders had not conducted themselves in accordance with the culture of respect within the ANC.
Malema is not present for the announcement but he and his co-accused have already been advised of the findings against them, and their right to appeal their sentence. Further updates to follow.
Malema, and all other respondents have been granted 14 days to appeal.
